What are disbursements?
Literally, this comes from "to take money out of a purse". In a legal context it means funds that a law firm pays, expends or advances to a third party on behalf of a client.
When refinancing or selling a house, why are Estoppel Certificates not included in flat rate fees?
Estoppel Certificates are required only for the sale or refinancing of condominiums. It is a certificate that guarantees that no funds are past due to the condominium corporation by the property owner. Each condo management company charges a different amount for these (usually between $150 and $250) so it does not work to charge all clients for this amount. Our firm does mark up the cost, it is just passed straight on to the client.
Why do Purchases cost more than sales?
There are two reasons. First, there are much more disbursements paid. Most of these go to the Land Titles Office for fees. Secondly, there is more work involved with a purchase than a sale.
What is the difference between a contested divorce and a uncontested divorce?
A contested divorce is one where the soon to be former spouses cannot agree on how to split up matrimonial assets, share custody and/or access to children set support payments, etc.. When the parties cannot come to an agreement on their own, then a lawyer can help to come to a resolution either by negotiated agreement or litigation (court). If the parties have everything decided and just need to get the paperwork done to legally end their marriage, then that is considered an uncontested divorce (or desk divorce because the parties do not have to go to court and the paperwork is put on a judge's desk for finalization.).
Why does the law firm have to photocopy my ID?
We are required by the Law Society and financial institutions to confirm the identity of our clients. We must keep such confirmation on file for at least 7 years. Even the parent of a lawyer is required to submit ID in case of an audit of our accounts. The photocopy will only be shared as required with your financial institution, as required by law or the Law Society or with your consent. Under our confidentiality rules and client privilege, unless we have your consent, we are not permitted to disclose that you are a client of the firm.
